These Terms and Conditions govern the supply, delivery, installation and use of products and services provided by Pacific Racking & Shelving (Pty) Ltd (“Pacific Racking”, “the Company”, “we”, “our”).

By accepting a quotation, placing an order, or engaging the Company’s services, the Customer agrees to these Terms and Conditions.

1. Quotations

All quotations issued by Pacific Racking & Shelving:

• are valid for 14 days unless otherwise stated
• are exclusive of VAT unless specifically indicated
• are based on information supplied by the Customer

If project scope, quantities, site conditions, or specifications change, the Company reserves the right to revise the quotation.

Prices may be adjusted prior to order confirmation due to:

• supplier price increases
• material cost fluctuations
• exchange rate changes

2. Orders

An order is considered confirmed when:

• the Customer accepts the quotation in writing
• a deposit payment is received
• the Company commences work

Once an order is confirmed, cancellation may result in charges for:

• materials already ordered
• manufacturing already commenced
• design work completed
• labour or installation scheduling

3. Payment Terms

Payment terms will be specified on the quotation or invoice.

Unless otherwise agreed in writing:

• a deposit is required prior to procurement or manufacturing
• the balance must be paid before delivery or installation

Pacific Racking & Shelving reserves the right to:

• delay delivery
• suspend installation
• withhold products

until payment obligations are met.

Interest may be charged on overdue accounts at the maximum rate permitted by South African law.

4. Delivery

Delivery dates provided are estimates only.

Delivery schedules may be affected by:

• supplier availability
• manufacturing lead times
• logistics delays
• weather conditions
• labour disruptions

The Company cannot be held responsible for delays outside of its control.

The Customer must ensure the delivery location is:

• accessible
• safe
• suitable for offloading

Additional costs may apply if delivery cannot be completed due to site conditions.

5. Installation

Where installation is included in the quotation:

The Customer must ensure the site is ready for installation, including:

• clear and unobstructed installation areas
• adequate lighting
• safe working conditions
• access for equipment and installation teams

If installation cannot proceed due to site readiness issues, additional charges may apply.

The Company will not be responsible for delays caused by other contractors or site conditions.

6. Structural Responsibility of the Building

Pacific Racking & Shelving supplies and installs storage systems.

The Company does not assume responsibility for the structural suitability of the building in which the system is installed.

The building owner or customer must ensure that:

• the floor slab is suitable for the intended load
• the building structure supports the installation
• foundations are adequate for load distribution

Any structural engineering verification required remains the responsibility of the building owner.

7. Health, Safety and Regulatory Compliance

All related Health and Safety requirements, Fire Regulations and approvals from Council or other institutions remain the responsibility of the end user or building owner.

Pacific Racking & Shelving can issue Capacity Certificates or load guarantees for the storage systems supplied.

However, Pacific Racking & Shelving cannot be held responsible for required local approvals applicable to the building itself or the application of the storage system, as this remains the legal responsibility of the building owner or end user.

8. Load Capacity and Safe Use

All storage systems are designed with specified load limits.

It is the Customer’s responsibility to ensure that:

• racks are loaded within the specified limits
• pallets are correctly placed
• loads are evenly distributed
• operators are trained in safe racking use

Overloading or misuse may result in structural failure and void any warranty.

9. Forklift Damage and Operational Damage

Industrial racking systems are vulnerable to impact damage.

Pacific Racking & Shelving cannot be held responsible for damage caused by:

• forklifts
• pallet jacks
• warehouse vehicles
• improper loading methods
• operational misuse

The Customer is responsible for ensuring regular inspections and repairs after impact damage.

10. Inspection and Maintenance

The Customer must conduct regular safety inspections of all racking systems.

Industry best practice recommends periodic inspections to identify:

• bent uprights
• beam damage
• loose anchors
• structural deformation

Failure to maintain the system properly may lead to unsafe conditions.

Pacific Racking & Shelving cannot be held liable for damages resulting from lack of inspection or maintenance.

11. Warranty

Products supplied by Pacific Racking & Shelving carry manufacturer warranties where applicable.

Warranty does not cover:

• impact damage
• misuse or overloading
• unauthorised modifications
• corrosion caused by environmental conditions
• normal wear and tear

12. Limitation of Liability

To the maximum extent permitted by law, Pacific Racking & Shelving shall not be liable for:

• indirect or consequential damages
• loss of profit
• operational downtime
• loss of goods stored on racking systems
• damage caused by misuse or overloading

Total liability shall in all cases be limited to the value of the products or services supplied.

13. Ownership of Goods

All products remain the property of Pacific Racking & Shelving until full payment has been received.

The Company reserves the right to reclaim goods in the event of non-payment.

14. Intellectual Property

All designs, drawings, layouts, and specifications prepared by Pacific Racking & Shelving remain the intellectual property of the Company unless otherwise agreed in writing.

15. Force Majeure

The Company shall not be liable for delays or failure to perform obligations caused by events beyond its control, including:

• supply chain disruptions
• natural disasters
• labour strikes
• government regulations
• transport interruptions

16. Governing Law

These Terms and Conditions shall be governed by the laws of the Republic of South Africa.

17. Amendments

Pacific Racking & Shelving reserves the right to update these Terms and Conditions at any time.
The latest version will be available on the Company website.
